For mortgages, the recording date is what counts. Anything that happens after that date doesn’t affect benefits you receive from donating the mortgage.  With regular real estate, the recording date is your cut off of problems you’ve been dealing with and locks in the benefits you receive from donating your real estate. In regards to the timeshare resort approval of passing future billing to someone else, that is required by law based on Real Estate law and the recording date.

The difference with Right-To-Use Timeshare Membership Contracts is that they are not governed by Real Estate law. The resort is a party to the original contract and must give permission to change the terms of the contract. DO NOT confuse your CC&Rs and contract you signed at purchase with a RTU Membership Contract.
